1. Digital Intermediary & Content Accuracy

1.1 Intermediary Status: Per the Information Technology Act, 2000, the platform acts strictly as an intermediary/aggregator. It does not own the vehicles unless expressly stated as "Company Owned" or "Inventory-Led".

1.2 User-Generated Content (UGC): Sellers are solely responsible for the accuracy of their listings, including photos, odometer readings, and history. The platform reserves the right to screen, modify, or remove any listing found to be misleading or in violation of its standards.

1.3 License to Use Data: Users grant the platform a perpetual, royalty-free license to use their vehicle photos and data for marketing, research, and improving valuation algorithms.

2. Booking, Payments, and Escrow

2.1 Token & Convenience Fees: The platform may charge a non-refundable convenience fee for digital services. However, a "Booking Fee" is typically fully refundable if the buyer rejects the car after a physical inspection, provided the request is made within a specified timeframe (e.g., 24–48 hours).

2.2 Payment Limits & Compliance:

  • 2.2.1 Cash payments are strictly capped at ₹1,99,999 per transaction to comply with Section 269ST of the Income Tax Act.

  • 2.2.2 Any amount exceeding this limit must be paid via NEFT, RTGS, or IMPS from the buyer's own bank account.

2.2.2 PAN Requirement: A valid PAN Card is mandatory for all transactions above ₹50,000.

3. Post-Sale Policies & Fair Usage

3.1 "Buy, Try, Decide" (7-Day Shield). For this to be enforceable, include a Fair Usage Policy:

3.2 Forfeiture of Booking: If a buyer fails to provide necessary KYC documents or complete the final payment within the stipulated time (e.g., 3 working days post-allocation), the platform reserves the right to cancel the order and forfeit the token amount.

4. RTO & Transfer Obligations

4.1 RC Transfer Timeline: While the platform may facilitate the process, the legal responsibility to initiate a transfer rests with the buyer and seller. Intra-state transfers must be completed within 14 days; interstate within 45 days.

4.2 Indemnity Post-Handover: The buyer agrees to be solely responsible for all traffic violations (e-challans), accidents, and third-party liabilities from the exact minute they take possession of the vehicle.

4.3 Hypothecation Removal: It is the seller's responsibility to provide a valid NOC from the bank if the vehicle has an active loan before listing it as "Cleared" on the marketplace.

5. Prohibited Activities for Marketplaces

4.1 Anti-Scraping: Users are strictly prohibited from using automated tools (bots/crawlers) to "scrape" pricing databases or vehicle listings for commercial resale.

4.2 Lead Misuse: It is prohibited to submit a lead for any purpose other than a genuine intent to purchase. Using the platform to gather data for competing businesses results in an immediate permanent ban.
